Terms of Service

These terms govern the use of CANTA, a service of Deep Blue Dodo LLC.

What CANTA is

CANTA turns a message or lyric into an AI-generated song, which you can then share. CANTA is made with AI.

Who may use CANTA

You must be at least 13 years old to use CANTA. If you are under 18, you may use CANTA only with the permission of a parent or guardian. This permission is declared by you and is not separately verified at present. Purchases require adult age or the consent of a parent or guardian.

Starter allowance and credits

New users receive a one-time free starter allowance of one song generation; access during the current beta phase may be managed by invitation. Beyond that, credit packs can be purchased. The details — what a credit is, prices, payment, refunds — are governed by the section "Credits, Prices, and Payment".

Availability and changes

CANTA is provided with reasonable care. Uninterrupted or error-free operation cannot be guaranteed; individual features may evolve, change, or be discontinued. Material changes to these terms will be communicated to you in an appropriate manner.

Liability

For intent and gross negligence, and for damage arising from injury to life, body, or health, Deep Blue Dodo LLC is liable without limitation under the applicable statutory rules. For slight negligence, Deep Blue Dodo LLC is liable only for breach of a material contractual obligation (an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely), and in that case limited in amount to the foreseeable damage typical for this type of contract. Any further liability is excluded. Mandatory statutory liability, in particular under the German Product Liability Act, remains unaffected.

Right of withdrawal for digital content

For free digital content — such as the free starter allowance — any right of withdrawal already lapses once performance of the contract has begun (Section 356(6) No. 1 of the German Civil Code, BGB), that is, when song generation starts.

When buying credits (digital content not supplied on a tangible medium), the right of withdrawal may lapse early (Section 356(6) No. 2 BGB): in the checkout flow you expressly consent to performance beginning before the end of the withdrawal period and acknowledge that, by giving that consent, you lose your right of withdrawal once performance begins; you receive a confirmation of the contract recording both by email on a durable medium (Section 312f(3) BGB). Performance begins when you start the first song generation from the respective purchase; from that moment, the right of withdrawal for that purchase has lapsed. Credits, Prices, and Payment

This section applies once credits can be purchased in CANTA.

What a credit is

One credit entitles you to generate one song; each generation delivers up to two versions of the song. New users receive a one-time free starter allowance. Purchased credits never expire. Any starter allowance you still have is kept when you buy — it is neither offset nor deleted; credits once granted are never taken away from you retroactively.

No subscription

CANTA currently sells one-time credit packs only. There is no subscription, no auto-renewal, and no recurring charge. Should that ever change, these terms will be updated beforehand and the statutory requirements for subscriptions implemented.

Purchase and prices

Credits can be purchased exclusively on the website (canta.lol) with a claimed (email) account — never inside an app. For consumers in the European Union, the price shown at purchase is the total price including your country's statutory VAT. Payment is handled by the payment provider Stripe; the payment page is hosted by Stripe, and CANTA never receives or stores your card details. Your receipt comes from Stripe. Which pack is available at which price follows from the offer shown in the purchase flow at the time; the total price displayed there is decisive. Purchases require adult age or the consent of a parent or guardian.

Failed generations

A song generation can fail — for example due to a technical error, a timeout, or because our providers' upstream content moderation rejects the submitted text (rejections based on the content itself do occur). In that case the credit used is returned to your balance automatically, without any request needed. This does not create a money refund, and it does not reopen a refund possibility already closed under "Refunds and withdrawal": a failed generation is still a use of the service, because we processed the request and the cause of a rejection may lie in the submitted content itself. We do not itemise or individually explain failures; we do not review or adjudicate our providers' rejection decisions case by case.

Refunds and withdrawal

Money refunds follow one simple, technically enforced rule: a purchase is refundable as long as not a single credit from it has been used. The first song generation from a purchase permanently closes the refund option for that purchase. Details — including your statutory right of withdrawal and the withdrawal instruction — are on the "Withdrawal and Refunds" page. Your mandatory statutory rights remain unaffected.

Provider dependency and storage of your songs

Song generation depends on upstream providers (see "Content Rights") who may change, suspend, or discontinue their service at any time. If a generation fails for that reason, the "Failed generations" section applies (credit returned); beyond that, we cannot promise availability of the provider chain. CANTA stores generated songs on its own infrastructure immediately. The availability of your songs rests on that own storage — not on the upstream providers' systems, which by their own account delete generated media files after around 14 days. Re-generation or re-retrieval from the providers' systems is not promised.

Changes to offers and prices

A completed purchase is immutable: credits already granted are never reduced or devalued by later price or offer changes. New prices and pack configurations apply to future purchases only.

Content Rights

This section governs the rights in the text you enter and in the generated song.

The text you enter

The rights in the text you enter (your message or lyric) remain with you. So that Deep Blue Dodo LLC can generate, store, deliver, and share the song you request, you grant it a non-exclusive, worldwide licence in that text to the extent needed for those purposes. This licence goes no further than is necessary to operate the service.

The generated song

The song is produced by an AI provider that CANTA reaches through a gateway service (kie.ai) and Suno's underlying model. CANTA can grant you only those rights in the generated song that CANTA itself receives from its providers.

There are honest limitations in this rights chain:

  • Suno's public terms assign rights in generated content only on paid tiers; at the same time, Suno makes no representation that any copyright vests in AI-generated output at all.
  • CANTA today reaches Suno only indirectly, via kie.ai. Kie.ai's published Terms of Use contain no provision on rights in generated output. Kie.ai's support has informally told us that generation runs on paid Suno accounts and that kie.ai claims no rights in the output itself — but kie.ai cannot provide a license document. That statement is informal and not legally binding; the rights actually obtained through this chain still cannot be conclusively confirmed.

For that reason, CANTA does not promise you ownership or commercial-use rights in the generated song. You receive the song — to the extent we receive rights in it, we pass them through to you, and in addition we grant you, on our own behalf, a license in the delivered file — for personal, non-commercial use. That includes listening, keeping, and sharing it, including publicly on social networks and messengers (for example as a post or message). Not permitted without our prior written confirmation is commercial exploitation, in particular sale, distribution to music streaming platforms, and use in advertising — we reserve the right to permit this once our providers confirm commercial rights in writing.

CANTA makes no warranty that any copyright arises in the generated song or vests in you, that it can be registered, that it is unique or exclusive (the same or a similar song may be generated for others), or that it does not infringe third-party rights.

Your responsibility for submitted content

You are responsible for the text you submit. You warrant that you hold the necessary rights and that the content infringes no third-party rights and does not violate the rules below.

Prohibited content

Prohibited content includes, in particular, content that:

  • infringes third-party rights, in particular copyright, trademark, or other protected rights;
  • is unlawful, harmful, threatening, abusive, harassing, excessively violent, defamatory, vulgar, obscene, or pornographic;
  • expresses hatred toward persons or groups — in particular on grounds of origin, religion, gender, sexual orientation, or disability — or endorses violence against them;
  • impersonates another person or origin (for example, suggesting the content was created by someone who did not create it);
  • serves to build competing products.

This list summarises the relevant requirements of the providers used and may be supplemented.

In addition, CANTA may, exercising reasonable discretion, decline to generate a content item or suspend its public serving where, in CANTA's assessment, it substantially endangers the service, its users, third parties, or the proper operation of the offering — even where unlawfulness has not been conclusively established. Suspending public serving is the primary, less severe measure; termination of the user relationship follows the "Reports, Moderation, and Termination" section.

Reports, Moderation, and Termination

This section describes how content is reported, how CANTA handles it, and how the user relationship ends.

Reporting content

You can report content that violates these terms at support@canta.lol. Please identify the content concerned and the reason for the report.

Review and takedown

Reported content is reviewed. If CANTA finds a violation, the public serving of the content concerned may be suspended. Honest clarification: such a takedown first stops public serving (a suspension) and is not by itself a completed hard erasure; the actual deletion follows a short, documented hold as described in the privacy policy.

CANTA is under no obligation to generally and actively monitor content before it is generated or published. CANTA acts on a case-by-case basis, in particular following reports or on becoming aware of unlawful content. In addition, CANTA may, exercising reasonable discretion, suspend content that substantially endangers the service or its users; the standards for this are set out in the "Content Rights" section (prohibited content).

Repeated or serious violations

For repeated or serious violations, CANTA may restrict access or terminate the user relationship. The severity of the violation and the circumstances are taken into account.

Termination by you

You may stop using CANTA at any time. The consequences for stored content and its deletion follow the privacy policy.

AI Content Disclosure

CANTA is made with AI.

CANTA lets people turn a written or spoken message into a song. Every song produced through CANTA is generated entirely by artificial intelligence. Songs are not performed or sung by human artists.

How the content is created

  • Song generation: The music is produced by a generative music model from the provider Suno, which CANTA reaches through the kie.ai gateway. As things stand today, CANTA does not call Suno directly — only through kie.ai.
  • Voice transcription: When lyrics are entered by voice, the recording is converted to text. This conversion runs first on CANTA's own infrastructure (local-first); the Groq service is used only as a fallback. CANTA does not store the raw recording (see the privacy notice for detail).

Provider roles (stated honestly)

  • Suno is the underlying music model. Today CANTA reaches Suno only indirectly, via kie.ai.
  • kie.ai is the gateway through which generation is triggered. kie.ai's contractual terms for handling the content sent to it are not publicly verifiable, so CANTA cannot represent any kie.ai commitment about storage, retention, or non-use for training.
  • Groq is used only as a fallback for voice transcription.

Labelling

CANTA signals its use of AI prominently: through the line "CANTA is made with AI." in the footer of the landing page and on the legal pages. Individual shared songs carry no additional label.

This reflects Regulation (EU) 2024/1689 (the AI Act), Article 50:

  • The machine-readable marking of artificially generated audio under Article 50(2) falls, on our reading, on the provider of the generating system (here the model/gateway side), not on the downstream service CANTA.
  • The visible-disclosure duty under Article 50(4) concerns "deepfakes"; for artistic works an exception limits that disclosure to a manner that does not hamper the display or enjoyment of the work.

This assessment is reviewed and updated when the legal situation or the provider chain changes.
